A. It shall be unlawful for any vehicle for hire driver to smoke in the presence of any passenger without the consent of such passenger.

B. Notwithstanding subsection A of this section, it shall be unlawful for any person to smoke in a vehicle for hire if oxygen tanks or other devices containing inflammable materials are present in the vehicle. (Ord. 3160 § 2, added, 09/18/2018)
