A person commits the offense of violation of the open container law if the person possesses on one’s person, while in or upon any street, alley, public ground, or other public place unless the place has been licensed for that purpose by the Oregon Liquor Control Commission, any bottle, can or other receptacle containing any alcoholic liquor, which has been opened, or a seal broken, or the contents of which have been partially removed. It shall not be a violation of this section, however, if the bottle, can or other receptacle is within a motor vehicle and in compliance with ORS 811.170, the open container law in a motor vehicle. Open containers prohibited is a Class III violation. (Ord. 3026, 2010.)
